Terms of Service

These Terms of Service ("Terms") govern your access to and use of the services provided by Votion Platform Inc. ("Votion," "we," "us"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services. We may update these Terms; we will provide reasonable notice of material changes.

1) US‑Only; Eligibility; Accounts
  • US‑only

    The Services are currently offered in the United States only.

  • Eligibility

    You must be 18+ to create an account and enter binding transactions. Users 13–17 may use the Services only with parent/guardian permission and supervision.

  • Account security

    Provide accurate information and keep your credentials confidential. You are responsible for activity on your account.

2) Platform Role; Operators; No Common Carrier

Votion is a marketplace platform that enables discovery, coordination, and booking of services (currently private group transportation). Unless expressly stated, independent operators provide the underlying transportation services. Votion is not a common carrier and does not supervise riders or act as a chaperone.

3) Bookings, Fees, and Payments
  • Payments

    Payments are processed by Stripe; operator payouts use Stripe Connect. You authorize applicable charges (fares, platform fees, taxes) disclosed at checkout.

  • Credits

    Platform credits (if offered) are promotional, have no cash value, and are non‑transferable.

  • Receipts & enhancements

    Optional enhancements may be offered. Operators may submit receipts for review and payout eligibility.

4) Cancellations and Refunds

Cancellation/refund terms may vary by service and operator. For transportation, the applicable cancellation windows, fees, and refund eligibility are shown at checkout and/or in your confirmation. Some fees (e.g., reservation or processing fees) may be non‑refundable.

5) Minors & Families

Children must be accompanied by a parent/legal guardian or a responsible adult authorized by them for any ride. Drivers are not chaperones or childcare providers. The supervising adult is responsible for child safety and compliance with applicable seat belt/child restraint laws. Votion does not provide child seats.

6) Conduct and Safety
  • On‑time arrival; follow operator instructions; comply with laws
  • No harassment, abuse, dangerous or illegal items, or vandalism
  • We may suspend/terminate for violations or safety risk
7) Communications (SMS/Email)

By opting into SMS, you consent to receive texts about your account and bookings. Consent is not a condition of purchase. Message frequency varies; message/data rates may apply. Reply STOP to cancel and HELP for help. Manage preferences in your account.

8) Intellectual Property; License

The Services, content, and trademarks are owned by Votion or its licensors. We grant you a limited, non‑exclusive, non‑transferable license to use the Services for personal, non‑commercial purposes, subject to these Terms.

9) Disclaimers; Limitation of Liability

The Services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non‑infringement. We are not responsible for acts or omissions of operators or other users. To the maximum extent permitted by law, Votion’s aggregate liability arising out of or relating to the Services will not exceed the greater of (a) the amounts you paid to Votion in the 12 months preceding the claim, or (b) $100.

10) Indemnity

You agree to indemnify and hold harmless Votion from claims arising out of your use of the Services, your breach of these Terms, or your interactions with operators or other users.

11) Disputes; Governing Law & Venue

These Terms and any dispute will be governed by the laws of the State of Colorado, without regard to conflict‑of‑law principles, and you agree to the exclusive jurisdiction and venue of the state and federal courts located in Denver County, Colorado. Where required by law, consumer protections of your state of residence may apply.

12) Termination

We may suspend or terminate your access for violations, legal risk, or harm to others. You may close your account at any time.

Transit Addendum

Effective Date: October 31, 2025

This Addendum governs private group transportation and related enhancements coordinated through Votion.

  • Scope

    Marketplace matching for private group rides associated with events.

  • Booking model

    Host creates ride; reservation fee; participants pay their share by deadlines; waitlists/replacements may apply.

  • Operator duties

    Licenses/permits/insurance; vehicle standards; punctuality; lawful conduct.

  • Passenger rules

    Be on time; follow instructions; no prohibited items; minors must be accompanied by an authorized adult.

  • Enhancements/receipts

    Optional add‑ons; receipts may be reviewed for payout eligibility and fraud prevention.

  • Cancellations/refunds

    Windows, fees, and eligibility are shown at checkout/confirmation; certain fees may be non‑refundable.

  • Safety & incidents

    Report concerns to the operator and Votion support; call 911 in emergencies.
